By accessing or using the Tiri Tracker website (https://tiritracker.com) and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Description of Service
Tiri Tracker provides:

• A waitlist signup service for our upcoming product
• Information about the Tiri Tracker device (a proximity tracking system for children with ADHD)
• Future e-commerce services for product sales (when available)

Eligibility
You must be:

• At least 18 years old to use our services
• Capable of entering into a legally binding agreement
• Not prohibited from using our services under applicable law

Parents or legal guardians may purchase products for use by children.
Waitlist Terms

Joining the Waitlist:

• Provides no guarantee of product availability
• Does not constitute a purchase agreement
• May be canceled at any time by you or us
• Does not obligate you to purchase

We Reserve the Right to:

• Limit the number of units per customer
• Change pricing before launch
• Modify product specifications
• Cancel or delay launch

Intellectual Property Rights
Our Content: All content on the Tiri Tracker website, including:

• Text, graphics, logos, images
• Software, code, algorithms
• Design elements and layout
• Product designs and specifications

You May:

• View and use the website for personal, non-commercial purposes
• Share links to our website

You May NOT:

• Copy, reproduce, or distribute our content without permission
• Modify or create derivative works

• Reverse engineer our products or technology

User Conduct
You agree NOT to:

• Harass, abuse, or harm others
• Violate any laws or regulations

• It is NOT a treatment for ADHD
• It is NOT a substitute for medical advice, diagnosis, or treatment
• Always consult qualified healthcare providers for medical concerns
• Do not rely on Tiri Tracker for safety-critical applications

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE ARE NOT LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Lost profits, data, or opportunities
• Personal injury or property damage (except where prohibited by law)
• Third-party actions or services

MAXIMUM LIABILITY: Our total liability shall not exceed the amount you paid for the product or service, or $100 USD, whichever is greater.

Some jurisdictions do not allow limitation of liability for personal injury or consequential damages, so these limitations may not apply to you.

Indemnification
You agree to indemnify and hold harmless Tiri Tracker, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of our products or services
• Your violation of these Terms
• Your violation of any rights of others
• Misuse of the product

Children's Use
The Tiri Tracker device is designed for use by children ages 6-14 under parental supervision. Parents/guardians are responsible for:

• Proper setup and maintenance
• Teaching proper use
• Supervising younger children
• Any misuse by their children

Termination
We May Terminate or Suspend:

• Your access to our website or services
• Your waitlist registration
• Your orders (with refund)

You May Terminate:

• Your waitlist registration at any time
• Your account (when accounts are available)

Upon termination:

• Your right to use our services ends immediately
• Provisions that should survive (warranty disclaimers, limitations of liability) remain in effect

Dispute Resolution
Governing Law: These Terms are governed by the laws of Taiwan (Republic of China), without regard to conflict of law provisions.

Dispute Process:

1. Informal Resolution: Contact us at hello@tiritracker.com to attempt resolution
2. Mediation: If unresolved after 30 days, we agree to attempt mediation
3. Arbitration: Disputes may be resolved through binding arbitration (if available in your jurisdiction)
4. Small Claims Court: You may pursue claims in small claims court

Class Action Waiver: To the extent permitted by law, disputes must be brought on an individual basis. You waive the right to participate in class actions or class-wide arbitration.
Jurisdiction: For disputes not subject to arbitration, you agree to the jurisdiction of courts in Taipei, Taiwan.

Changes to Terms
We may update these Terms at any time. Changes will be effective when posted. Continued use after changes constitutes acceptance.

Material Changes:

• Will be highlighted on the website
• Will update the "Last Updated" date

Miscellaneous
Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Tiri Tracker.

Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment: You may not transfer your rights under these Terms. We may transfer our rights to a successor entity.

Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, etc.).
